Article 1 – Parties

Article 2 – Subject

The subject of this agreement is the sale and delivery of the product(s), the specifications and sales price of which are detailed below, that the BUYER has ordered electronically via the Seller’s website at https://{{SabitTanimlar.site_adres}}, within the scope of the Consumer Protection Law No. 4077 and the Regulation on Distance Contracts, and to define the rights and obligations of both parties.

The Buyer acknowledges and declares that they have been informed by the Seller in a clear and comprehensible manner suitable to the internet environment, and that they have confirmed electronically all preliminary information about the seller’s identity, address, contact details, product specifications, price including taxes, payment method, delivery terms and costs, and the procedure to exercise the right of withdrawal, before placing an order.

The preliminary information on the website https://{{SabitTanimlar.site_adres}} and the invoice issued for the order placed by the Buyer are integral parts of this contract.

Article 3 – Product/Payment/Delivery Information

The type, quantity, brand/model, price, payment method, delivery recipient, delivery address, billing details, and shipping cost of the products ordered electronically are stated below. The person billed must be the same as the person entering into this agreement. The Buyer accepts full responsibility for any damages caused by incorrect or missing information.

If the information provided by the Buyer is inaccurate or incomplete, the Seller reserves the right to suspend the order. If the Seller cannot reach the Buyer within 15 days using the contact details provided, the order will be cancelled to prevent damage to either party.

Article 4 – Date of Agreement and Force Majeure

The agreement date is the date the Buyer placed the order: {{SabitTanimlar.ImzaTarihi}}.

Events beyond the control of either party, which arise after the agreement date and prevent either or both parties from fulfilling their obligations partially or entirely, are considered force majeure (natural disasters, war, terrorism, riot, changes in legislation, confiscation, strikes, lockouts, or significant failures in production and communication facilities). The affected party must inform the other party immediately in writing.

If the force majeure continues for more than 30 days, either party has the right to unilaterally terminate the agreement.

Article 5 – Seller’s Rights and Obligations

5.1. The Seller agrees to fulfill all its obligations under this agreement, in accordance with the applicable laws, except in cases of force majeure.
5.2. Persons under 18 years old cannot purchase from {{SabitTanimlar.firmadi}}. The Seller assumes the age provided by the Buyer is accurate.
5.3. The Seller is not responsible for pricing errors caused by system malfunctions or unauthorized interventions on the website https://{{SabitTanimlar.site_url}}.
5.4. Payments can be made via credit card (Visa, MasterCard, etc.) or bank transfer. Orders not paid within one week will be cancelled. Orders are processed once payment is confirmed.

Article 6 – Buyer’s Rights and Obligations

6.1. The Buyer agrees to fulfill all obligations under this agreement unless prevented by force majeure.
6.2. By placing an order, the Buyer accepts the terms of this agreement and agrees to make payment accordingly.
6.3–6.4. The Buyer confirms they have been informed about all pre-sale details and usage procedures on https://{{SabitTanimlar.site_url}} and have approved them electronically.
6.5. For returns, the Buyer agrees to return the product in original condition and packaging, with the invoice and delivery note.

Article 7 – Order/Payment Procedure

Orders are confirmed only after the Buyer approves the total cost. An order confirmation email must be sent before shipment.

In case of stock issues or other valid reasons, the Buyer will be informed, and alternative solutions such as replacement, delayed delivery, or cancellation will be offered.

If delivery becomes impossible, the payment is refunded within 10 days.

For unauthorized credit card use resulting in non-payment to the Seller, the Buyer must return the product within 10 days.

Article 8 – Shipping/Delivery Procedure

Orders are dispatched upon confirmation via the Seller’s designated courier.

Delivery is within 30 days after confirmation, extendable by 10 days upon prior notice.

Damaged packages should not be accepted and a report should be requested from the courier.

Once a package is accepted, it is assumed the courier fulfilled its duty.

Article 9 – Returns and Right of Withdrawal

The Buyer may withdraw within 7 days without penalty.

Returns must include the completed return sections on the invoice.

Personalized products are non-refundable.

Refunds are processed within 10 days after return approval.

Used, damaged, or unpackaged items are non-refundable.

For credit card purchases, refunds follow the bank’s installment return policies.

Cash refunds are not possible for card transactions.

Article 10 – Warranty

Products used as instructed are guaranteed for 2 years against manufacturing defects, under Consumer Protection Law No. 4077. Commercial transactions are governed by the Turkish Commercial Code.

Article 11 – Privacy

The Buyer’s data is not shared with third parties except under legal obligation.

Credit card information is not stored and only used for transaction processing.

Contact details may be used for communication and promotions with Buyer’s consent.

Article 12 – Dispute Resolution

In case of disputes, Consumer Arbitration Committees or Consumer Courts at the Buyer’s or Seller’s location, within legally determined limits, are authorized.

By placing an order, the Buyer is deemed to have accepted all terms of this agreement.
